These Terms of Service (“Terms”) govern your access to and use of DoctaDirect’s website, WhatsApp services, and any related services (collectively, the “Services”). By accessing or using DoctaDirect, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Services.

1. About DoctaDirect

DoctaDirect is a digital health service that provides medical guidance, nurse-led triage, and doctor escalation for pregnant women and children under the age of five. Services are delivered primarily through WhatsApp and are designed to support — not replace — in-person medical care.

DoctaDirect is not a hospital, clinic, or emergency medical service.

2. Eligibility

You may use DoctaDirect if you:

• Are at least 18 years old, or
• Are a parent or legal guardian seeking care for a child under five, or
• Have the legal authority to consent on behalf of another person

By using the Services, you confirm that you meet these eligibility requirements.

3. Nature of the Services

3.1 What DoctaDirect Provides

• Medical guidance and health information
• Nurse-led triage using standardized clinical protocols
• Doctor review and escalation when clinically appropriate
• Referral guidance to health facilities

3.2 Prescriptions

• In limited, low-risk cases, a licensed doctor may issue a prescription
• Prescriptions are not guaranteed and remain at the doctor’s discretion
• Before issuing any prescription:
  
  • Users may be required to provide valid government-issued identification
  • The doctor must verify the user’s identity through a video call
• DoctaDirect may refuse to issue a prescription if clinical, safety, or verification requirements are not met

3.3 What DoctaDirect Does Not Provide

• Emergency medical services
• In-person medical treatment
• Diagnosis or treatment intended to replace a physical medical consultation

In emergencies or severe danger signs, users must go immediately to the nearest health facility.

4. Medical Disclaimer

The information provided through DoctaDirect is for medical guidance and triage purposes only. While DoctaDirect works with certified nurses and licensed doctors, the Services do not establish a traditional doctor–patient relationship.

Health decisions remain the responsibility of the user. DoctaDirect shall not be liable for outcomes resulting from delayed facility care, failure to seek in-person treatment, or failure to follow referral advice.

5. User Responsibilities

By using DoctaDirect, you agree to:

• Provide accurate, complete, and truthful information
• Follow medical guidance and referral advice
• Use the Services only for lawful purposes
• Not misuse, abuse, or disrupt the Services
• Inform DoctaDirect promptly if your phone is lost, stolen, or your phone number changes

DoctaDirect is not responsible for communications sent to a phone number you no longer control if we have not been informed.

Providing false or misleading information may result in suspension or termination of access.

6. WhatsApp Communication

DoctaDirect delivers services through WhatsApp, a third-party platform. By using the Services, you acknowledge that:

• WhatsApp is not owned or controlled by DoctaDirect
• Messages are subject to WhatsApp’s own terms and privacy practices
• You are responsible for securing access to your phone and WhatsApp account

7. Fees and Payments

Some Services require payment through subscriptions or per-use fees. By enrolling in a paid plan, you agree to:

• Pay all applicable fees as communicated
• Understand that fees are generally non-refundable once services are delivered
• Accept that pricing, packages, or features may be updated with notice

8. Confidentiality and Data Protection

DoctaDirect takes confidentiality seriously. Personal and medical information is handled in accordance with our Patient Consent and Privacy Notice, which form part of these Terms.

Only authorized personnel may access user information. All staff are bound by professional confidentiality obligations.

9. Intellectual Property

All content, trademarks, logos, text, and materials provided by DoctaDirect are the property of DoctaDirect SARL or its licensors. You may not copy, reproduce, modify, or distribute any content without prior written consent.

10. Suspension or Termination

DoctaDirect reserves the right to suspend or terminate access to the Services if:

• These Terms are violated
• The Services are misused
• Continued use poses clinical, legal, or operational risk

11. Limitation of Liability

To the maximum extent permitted by law:

• DoctaDirect shall not be liable for indirect, incidental, or consequential damages
• Liability is limited to the amount paid for the Services during the applicable period
• DoctaDirect is not responsible for third-party services, including WhatsApp or external health facilities

12. Changes to the Terms

DoctaDirect may update these Terms from time to time. Continued use of the Services after updates are posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Democratic Republic of Congo. Any dispute shall be subject to the jurisdiction of the courts of Kinshasa.
